FAQs Regarding Personal Tax Code Registration Services
A personal tax identification number (TIN) is a unique 10-digit code assigned to taxpayers by the tax authorities. Each individual has their own TIN, used for tax declaration and payment to the government. This allows tax authorities to identify taxpayers, determine their tax liabilities, and manage tax records efficiently.
For individuals with regular income, obtaining a personal TIN is essential for declaring their income sources. Additionally, it is required in the following situations:
-
- Tax authorities use personal TINs to identify taxpayers and manage their tax payments and liabilities.
- Registering for a TIN and paying personal income tax demonstrates a citizen’s responsibility and obligation to their country.
- In some cases, failure to register for a TIN may result in penalties and loss of certain benefits, such as:
- Ineligibility for family deductions for dependents;
- No 10% deduction on personal income tax;
- No personal income tax refund for overpayment;
- Ineligibility for tax exemptions in cases of serious illness or natural disasters;
- Inability to access tax-related services quickly and conveniently.
A personal TIN unlocks a wealth of benefits, including:
- Family deductions: You can claim tax deductions for dependents.
Reduced income tax withholding: Your employer will withhold only 10% of your income for taxes (instead of 20%). - Tax refunds: You can receive a refund if you overpay your taxes.
- Tax reductions in special circumstances: You may be eligible for tax reductions in case of natural disasters, accidents, or serious illnesses. In severe cases, you might even be exempt from taxes.
- Convenient access to tax services: You can easily and quickly access various tax-related services.
According to Article 2 of the Law on Personal Income Tax 2007, the following individuals are subject to PIT:
- Resident individuals with taxable income arising within and outside the territory of Vietnam;
- Non-resident individuals with taxable income arising within the territory of Vietnam.
Taxable income, as defined in Article 3 of the Law on Personal Income Tax, includes:
- Income from business activities;
- Income from salaries, wages, and other income of a similar nature;
- Income from capital investment;
- Income from the transfer of real estate;
- Income from royalties (technology transfer, intellectual property rights, etc.);
- Income from franchising;
- Income from capital transfers;
- Income from winnings (lottery, contest prizes, gambling, etc.);
- Income from inheritance or gifts of securities, capital contributions in business establishments, real estate, economic organizations, and other assets subject to ownership or usage registration.
In most cases, individuals are issued a second TIN due to obtaining a new ID card (9 or 12 digits) or a citizen identification card (CCCD) upon changing their permanent residence registration to a different province or centrally-affiliated city.
According to Official Letter 896/TCT-KK, if the local tax authority at the new location has issued a new TIN based on the new ID card or CCCD, they are responsible for revoking the previously issued TIN. Taxpayers should only use the original TIN for all tax transactions.
Therefore, in this situation, taxpayers must update their tax registration information according to the instructions in Articles 12 and 13 of Circular 95/2016/TT-BTC.
Yes, non-resident individuals can register for a TIN online. The process for non-resident individuals is the same as for any other citizen in Vietnam.
